You might be surprised to learn that your aircraft registration is not necessarily tied to you yourself, but that it is entirely dependent on the aircraft. What does this mean? Well, that if the aircraft changes owners then the registration will go with the airplane. Now, the process by which this takes place will have a few different components. On one hand, of course, you have the sale itself, but an aircraft change of ownership will require you to submit the necessary form to officially transfer the registration. 

Regular Aircraft Change of Ownership

Going through an aircraft change of ownership is not necessarily quick or convenient, but it’s definitely simpler than you probably think it is. Of course, the general process will have different components that each address an aspect of the transfer of ownership, but today we are going to focus on the form you will have to submit in order to transfer the registration itself. If your aircraft does not classify as an ultralight one (see what that means below), you will do this through the change of ownership form available on our website. All you need to do is provide information about the aircraft, as well as both the current and the new owner.

Change of Ownership for Ultralight Aircraft

Now, if you need to change the ownership for an ultralight aircraft, the process is going to be slightly different. You are probably aware of whether or not your aircraft is considered ultralight, but in case you’re acting on behalf of the owner or aren’t sure for some reason, here are the parameters that determine this.

  • Basic ultralight aircraft will have a capacity of two people and an MTWO (maximum takeoff weight) of 544 kilograms (1,200 pounds). These must only be used under daylight visual conditions, operated from land or water, and with the appropriate ultralight pilot permit.
  • Advanced ones, on the other hand, will have a capacity of two people and an MTWO (maximum takeoff weight) of 559 kilograms (1,232 pounds). These must only be used under daylight visual conditions and with the appropriate ultralight pilot permit. The aircraft may only carry a passenger if the pilot has the necessary ultralight aeroplane passenger-carrying rating.

Regardless of the kind of ultralight aircraft in question, the specific form for ultralight aircraft change of ownership will apply for either. Just be sure to pick the right category when filling it out.

Aircraft Exchange of Ownership

Whether you are transferring the registration of your aircraft to a fellow Canadian citizen or you are exporting and selling the aircraft to a foreign entity, you will need to go through Transport Canada to make sure the title is updated as necessary. 

Transfer of Ownership Within Canada

There’s nothing complicated about an aircraft exchange of ownership between Canadian citizens. After all, there’s no reason for the registration itself to be that different beyond the subject who holds it. It’s essentially just changing hands, which is very simple given that the registration is tied to the aircraft itself and not exactly to the owner. So, if you are selling your aircraft to a fellow Canadian citizen, resident, or entity, all you will need to do is apply for a Transport Canada transfer of ownership so that the registration is passed along onto the new owner along with all the relevant documents attached to it. This way, the new owner will be able to support their ownership legally going forward.

Transfer of Ownership to a Foreign National

On the other hand, if you are selling the aircraft to a foreign person or entity, this means that there is no reason for the aeroplane to be registered with Transport Canada anymore. Because of this, you won’t have to transfer the ownership as much as delete it from the national registry. you will have to request the de-registration of the aircraft, an application that you can also find here on our website. It will be very important that you go through this process before fulfilling the sale to the new owner because the aircraft will need to be removed from the Canadian registry before it is registered again in a different country. An aircraft can’t be registered in two countries in most cases, so this will be a very important process to go through.
